Daniel Penny, a Marine veteran, "stepped in to save lives" when he placed a mentally ill homeless man in a deadly chokehold on a NYC subway last May, according to his counsel. Since the straphanger allegedly began assaulting passengers on the train, Penny, 25, has been charged with the mandatory manslaughter of Jordan Neely.
