The Supreme Court delivered a lower court decision overturning the ban on hold while considering an appeal in a one-page order. Abortion consultants who had started operating the treatment within six weeks after the lower court's decision would have to suspend.

In a decision released Tuesday, Fulton County Superior Court Judge Robert McBurney reversed Georgia's ban on abortions. Once a 'detectable human heartbeat' was present, the state passed a bill prohibiting abortions in July. Cardiac activity can be detected by an ultrasound as early as six weeks into a woman's pregnancy. Now abortions can only be controlled in the state where they were before the law was implemented, meaning that the procedure is now available up until 22 weeks of pregnancy. McBurney's decision comes after abortion rights campaigners said the law was unconstitutional when it was first introduced in 2019.
