The Mail on Sunday can reveal that a judge has criticised the BBC for a second time over its three-year campaign to keep swathes of emails secret. In a series of stinging remarks, Judge Brian Kennedy highlighted the 'disproportionate cost' of its 'burdensomely long' legal fight. Martin Bashir's 1995 Panorama interview with Princess Diana (left), in which the princess famously declared 'there are three of us in this marriage' - referring to Camilla, was a global scoop. It later emerged that Bashir had shown Diana's brother Earl Spencer forged bank statements to make Diana think her inner circle was selling her secrets.

The potentially explosive records may have exposed an ongoing cover-up of what BBC bosses knew about Bashir's deception in order to secure his controversial interview with Princess Diana. After fighting a two-year fight to keep them under wraps, last month, the Mail revealed how Judge Brian Kennedy had demanded the corporation hand over the emails and doubted its credibility.

Brian Kennedy, the former owner of Sale Sharks' rugby union, has bought almost 33% of the company's beauty market in Matthew Moulding, whose brands include Cult Beauty, Lookfantastic, and Myprotein. Given the investment, he became the sixth largest shareholder of THG, which was formerly known as The Hut Group. THG was the object of a private equity company Apollo's buyout attempt just weeks ago. Kennedy, the son of a window cleaner, made his fortune from a number of companies, including the double-glazing company Everest. Sir Terry Leahy, the former Tesco chief executive who holds a £16 million interest in THG, has previously invested in British companies.
